Arbitration and Mediation

Litigation is time consuming and expensive. The firm has extensive experience in structuring and utilizing, as appropriate, alternatives to litigation. Arbitration, while similar to litigation in that a third party decision-maker (or tribunal) acts as judge and jury, may provide an expeditious and economical alternative to litigation. Many contracts incorporate arbitration as the dispute resolution mechanism. The Firm regularly advises clients on when and how to utilize arbitration, and represents clients before arbitral tribunals such as the American Arbitration Association.

Mediation is a consensual process utilizing the services of an experienced, independent third party to find a common ground between the parties and can be used to avoid litigation. Or, once started, litigation can be ended by mediating at the appropriate time. Mediation can be a powerful tool in allowing the parties to structure a settlement which best fits the requirements of both parties. The Firm has extensive experience in representing clients in mediations, and has attorneys who are trained, registered mediators.
